If you work for an H-1B or green card sponsor, a layoff notice is one of the few public signs of a job cut before it happens. This note lists the notices filed so far in October 2026 by employers that also appear in DOL's H-1B or PERM records, and what those records show. It reports the filings as the states printed them and says nothing about why any employer made its decision.
Where these notices come from
The WARN Act makes an employer give "notification 60 calendar days in advance of plant closings and mass layoffs" (20 CFR 639.1(a)), and some states publish the notices. This site reads four: California, New York, Texas and Washington, held to October 14, 2026. Each is matched to DOL's records by the employer's name. Read from layoff notices on October 16, 2026.

| Oct 1 | Magic Leap, Inc. (Sunnyvale) | CA | Layoff, permanent | 5 | Dec 1, 2026 | 39 decided PERM cases, 8 pending; 381 H-1B LCAs |
Decided PERM counts are from DOL's disclosure files for fiscal years 2024 to 2026, through June 30, 2026, and H-1B LCA counts from DOL's LCA files since fiscal year 2020. Pending counts are DOL's live case-status record on October 16, 2026. One more October notice came from an H-2A agricultural employer with no PERM or H-1B filings, Manson Growers LLC in Washington, covering 275 employees.
The larger notices in September
Three sponsors with bigger filing records posted notices in September:
| Notice | Employer | Employees | Effective | In DOL's records |
|---|---|---|---|---|
| Sep 14 | Oracle America, Inc. (three notices, Washington and California) | 737 | Nov 13, 2026 | 2,299 decided PERM cases, 50 pending; 6,881 H-1B LCAs, 56 pending |
| Sep 22 | Microsoft (Washington) | 277 | Nov 21, 2026 | 598 PERM cases pending, all on hold since October 8 |
| Sep 29 | Workday Inc. (Pleasanton, California) | 142 | Nov 30, 2026 | 369 decided PERM cases, 11 pending; 2,282 H-1B LCAs, 5 pending |
What the rules say a layoff touches
- A PERM filed later. If the employer had a layoff in the area of intended employment within 6 months of filing, in the occupation or a related one, it "must document it has notified and considered all potentially qualified laid off" U.S. workers (20 CFR 656.17(k)(1)). The rule adds a recruitment step. It doesn't bar the filing.
- H-1B filings. Executive Order 14431, published September 23, 2026, tells State, Labor and Homeland Security to take into account on any LCA, H-1B petition or visa whether the employer laid off similarly situated US workers in the previous year or plans to. No rule saying how that's weighed had been published by October 16.
- A worker who loses the job. The H-1B grace period of up to 60 days still applies; DHS has proposed removing it, with comments open to November 10, 2026. Employer layoffs and your PERM walks through each stage of a green card case.
What these notices can't tell you
- Which jobs were cut. A notice gives a count and a site, never the roles or the visas of the people in it.
- Anything outside four states. A sponsor with no notice here may have filed one in a state this site doesn't read, or none was required.
- Whether a matched name is the same company in every case. Matching is by name, and each employer's page names the notices it carries.
Follow an employer
Every employer page on PERM employers lists the layoff notices matched to it, beside its filings. Any employer there can be followed by email, for when DOL moves its PERM cases as a group. Your own case is on the case lookup.
