By accessing or using PERM Tracker ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
These Terms constitute a legally binding agreement between you and PERM Tracker regarding your use of the Service.
PERM Tracker is a web application designed to help immigration attorneys and law firms track Permanent Labor Certification (PERM) cases through the Department of Labor (DOL) and USCIS processes. The Service is currently offered free of charge, though we reserve the right to introduce fees or subscription plans in the future.

You may delete your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms.

You retain ownership of all case data and content you enter into the Service ("User Content"). We do not claim any ownership rights over your User Content.
By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you. This license ends when you delete your account.
You are solely responsible for the accuracy and legality of your User Content. You represent that you have all necessary rights to enter the data you provide.
PERM Tracker and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. This includes:
You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, unless laws prohibit these restrictions or you have our written permission.

You acknowledge that you are solely responsible for independently reviewing, verifying, and validating all AI-generated content before relying on it for any immigration case or filing. The use of AI features does not diminish or transfer your professional responsibility or potential liability as a legal professional.
Immigration law is complex and frequently changing. AI-generated suggestions regarding PERM processes, deadlines, or requirements must be verified against current USCIS regulations, Department of Labor requirements, and applicable law before use in any matter.
AI-generated content may contain errors, inaccuracies, or "hallucinations" (plausible-sounding but incorrect information). We make no warranties regarding the accuracy, completeness, or currentness of AI-generated suggestions. You acknowledge that AI systems may:
You agree to independently verify all AI-generated information before relying on it for case strategy, filing decisions, client communications, or deadline calculations.
When you use the AI chat assistant, the following data may be processed by third-party AI service providers (including Google Gemini, OpenRouter, Mistral AI, Groq, and Cerebras):
These providers do not use your data to train AI models. See our Privacy Policy for detailed provider-specific data handling and retention policies.
Do not include Social Security numbers, passport numbers, financial account information, or other highly sensitive personal data in AI chat queries.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES ARISING FROM RELIANCE ON AI-GENERATED CONTENT WITHOUT INDEPENDENT VERIFICATION, AI ERRORS OR HALLUCINATIONS, MISSED DEADLINES BASED ON AI SUGGESTIONS, OR PROFESSIONAL MALPRACTICE CLAIMS RELATED TO USE OF AI FEATURES.
Your use of AI features is at your own risk. You acknowledge that you are a legal professional responsible for all work product and client advice, regardless of what tools or technologies you use to assist in your practice.
By using PERM Tracker, you consent to the processing of your data by third-party AI service providers as described above and in our Privacy Policy. AI conversation data is retained for 90 days and then automatically deleted. You may delete individual conversations at any time from the AI chat interface.
We use PostHog for product analytics (event tracking, feature usage), Sentry for error tracking with anonymized session replay, and Vercel for performance monitoring (Speed Insights). Analytics data from PostHog is routed through our domain (permtracker.app/ingest) rather than directly to a third-party domain. Session replay captures anonymized user interactions to help us diagnose and fix issues — no sensitive case data is included in session recordings. We also use Cloudflare Turnstile on our authentication forms (sign-up, sign-in, password reset) and Vercel BotID on our AI chat and authentication endpoints to prevent automated abuse; both process limited device and interaction signals but do not read the contents of form fields or message bodies. We additionally enforce per-IP and per-email rate limits on these endpoints. By using the Service, you consent to this data collection as described in our Privacy Policy.
You agree to indemnify, defend, and hold harmless PERM Tracker and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, United States, without regard to its conflict of law provisions.
Any disputes arising from these Terms or the Service shall be resolved in the courts located in the District of Columbia, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by:

PERM Tracker operates solely as a technology service provider. We provide software tools for case management and do not:
Authorized PERM Tracker personnel have technical access to the database infrastructure and may access your case data only when necessary to: provide technical support you have requested, diagnose and fix bugs affecting your account, maintain the security and reliability of the service, or comply with legal obligations. We do not routinely browse, review, or analyze the content of your case data outside of these limited circumstances.
Your data is stored on third-party cloud infrastructure providers (including Convex and related services). While we implement industry-standard security measures including:

FOR ATTORNEYS:You are solely responsible for determining whether use of cloud-based case management software is appropriate under your jurisdiction's rules of professional conduct. Many state bar associations have issued ethics opinions regarding cloud storage of client data. We recommend consulting your state bar's guidance on this matter.
If we receive a subpoena, court order, or other legal process seeking your data:
We do not provide legal advice regarding privilege claims or responses to legal process. You should consult with qualified counsel regarding any legal process affecting your data.
