Terms of Service

1. Agreement to Terms

By accessing or using PERM Tracker ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

These Terms constitute a legally binding agreement between you and PERM Tracker regarding your use of the Service.

2. Description of Service

PERM Tracker is a free web application designed to help immigration attorneys and law firms track Permanent Labor Certification (PERM) cases through the Department of Labor (DOL) and USCIS processes.

The Service includes:

  • Case tracking and management features
  • Calendar and timeline views
  • Deadline notifications and reminders
  • Data import/export capabilities

3. User Accounts

Registration

To use the Service, you must create an account by providing accurate and complete information. You may register using email/password or Google OAuth.

Account Security

  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • You may not share your account with others or create multiple accounts

Account Termination

You may delete your account at any time by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Upload false, misleading, or inaccurate information
  • Attempt to gain unauthorized access to the Service or other accounts
  • Use automated scripts, bots, or scrapers to access the Service
  • Interfere with or disrupt the Service or servers
  • Transmit viruses, malware, or other harmful code
  • Harass, abuse, or harm other users
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer, decompile, or attempt to extract the source code

5. User Content

Ownership

You retain ownership of all case data and content you enter into the Service ("User Content"). We do not claim any ownership rights over your User Content.

License to Us

By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you. This license ends when you delete your account.

Your Responsibility

You are solely responsible for the accuracy and legality of your User Content. You represent that you have all necessary rights to enter the data you provide.

6. Intellectual Property

Our Rights

PERM Tracker and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws. This includes:

  • The PERM Tracker name and logo
  • The application code and design
  • Documentation and help content

Restrictions

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code, unless laws prohibit these restrictions or you have our written permission.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We specifically disclaim:

  • Any warranty that the Service will be uninterrupted, timely, secure, or error-free
  • Any warranty regarding the accuracy or reliability of information obtained through the Service
  • Any warranty that defects will be corrected

Not Legal Advice

IMPORTANT: PERM Tracker is a case management tool only. The Service does not provide legal advice, and nothing in the Service should be construed as legal advice. The Service calculates dates based on general PERM processing rules, but you should always verify deadlines with official DOL and USCIS resources and consult with qualified legal professionals.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERM TRACKER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or case information
  • Missed deadlines or filing dates
  • Loss of profits or business opportunities
  • Service interruptions or downtime
  • Errors in date calculations or notifications

Because this is a free service, our total liability for any claims arising from your use of the Service is limited to the amount you paid to use the Service (which is zero).

9. Indemnification

You agree to indemnify, defend, and hold harmless PERM Tracker and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit to the Service

10. Service Modifications

We reserve the right to:

  • Modify or discontinue the Service (or any part) at any time
  • Change features, functionality, or pricing (if applicable)
  • Impose limits on certain features or restrict access

We will make reasonable efforts to notify users of significant changes, but are not obligated to do so.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including:

  • Violation of these Terms
  • Request by law enforcement or government agencies
  • Discontinuation or material modification of the Service
  • Extended periods of inactivity

Upon termination, your right to use the Service will immediately cease. You may request your data before termination.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the District of Columbia, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in the courts located in the District of Columbia, and you consent to the personal jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending an email notification (for material changes)

Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PERM Tracker regarding the Service and supersede any prior agreements.
